New Delhi: The Supreme Court in a landmark judgement on Monday upheld the validity & constitutionality of central government’s order that repealed Article 370 back in 2019.
The five-judge bench of the SC, led by CJI DY Chandrachud, announced that the Indian government’s order abrogating Article 370 was valid while hearing several petitions challenging the constitutionality of the same.

Besides sustaining the validity of the government’s order, the court simultaneously observed that Jammu and Kashmir became an integral part of the country when Raja Hari Singh surrendered its sovereignty by signing the Instrument of Accession on October 26, 1947.
The court further emphasized that Article 370’s provisions were interim (temporary) in nature and were just created due to the unrest and war situation in the territory.

Jammu & Kashmir’s statehood restoration shall take place at the earliest
Meanwhile, the court also directed the government to restore the statehood of the territories of Jammu & Kashmir as soon as possible. However, the court also made it clear that Laddakh will continue to be a union territory and will not be merged with Jammu & Kashmir.
