Delhi HC stays Mayor Shelly Oberoi’s notice for re-election of members of MCD’s Standing Committee

Justice Gaurang Kanth observed that the Mayor is conducting re-elections without declaring the results of the elections conducted on February 24.

New Delhi: Delhi High Court stayed Mayor Shelly Oberoi’s notice for the re-election of the members of the Standing Committee of the Municipal Corporation of Delhi (MCD). The re-election was scheduled to be held on February 27. Justice Gaurang Kanth observed that the Mayor is conducting re-elections without declaring the results of the elections conducted on February 24.

As reported by Live Law, in a Saturday Special Hearing, Justice Gaurang Kanth observed that prima facie conducting re-elections without declaring the results of the previous elections is a violation of Regulation 51 of New Delhi Municipal Council (Procedure and Conduct of Business) Regulations, 1997.

The court noted that no purpose would be served with re-election and thus, stayed the notice for the re-election of the six members of the Standing Committee, till the next date of hearing.

Delhi HC issued the notice on two petitions by BJP’s Kamaljeet Sehrawat and Shikha Roy, challenging Mayor Shelly Oberoi’s notice on February 24.

Delhi Civic Centre witnessed a ruckus and another clash between AAP and BJP councillors. Videos of scuffle and sloganeering went viral while councillors from both factions alleged each other of manhandling. An AAP Councillor Ashok Kumar Maanu collapsed during the clash and accused BJP councillors of beating him.

Meanwhile, Mayor Shelly Oberoi also alleged BJP councillors of hitting her and Atishi launched a verbal attack on BJP while addressing the press.

On the other hand, BJP councillors alleged their AAP counterparts of hitting them and said that the Mayor tried to declare the votes invalid as three candidates each of AAP and BJP won the elections.
