BJP-RSS against reservations, doesn’t want SC/STs to progress: Rahul Gandhi on SC verdict

Congress leader Rahul Gandhi targeted the BJP and RSS claiming that they are against reservations following the Supreme Court upholding 2018 amendments to the SC/ST Act.

BJP & RSS’s ideology is against reservations. They never want SC/STs to progress. They are breaking the institutional structure, Rahul Gandhi said on Monday.

Saying it is in DNA of RSS and BJP to try and erase reservation, Rahul Gandhi said, I want to tell SC/ST/OBC and Dalits that we will never let reservations come to an end no matter how much Modi ji or Mohan Bhagwat dream of it.

Supreme Court on SC/ST Act

The Supreme Court on Monday upheld the constitutional validity of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2018 that ruled out any provision for anticipatory bail for a person accused of atrocities against Scheduled Castes/Scheduled Tribes.

A bench comprising Justice Arun Mishra, Justice Vineet Saran and Justice Ravindra Bhat, pronounced the verdict on pleas challenging the Act.

In October last year, the Bench had hinted that it will uphold amendments made by the Centre in SC/ST Act to restore immediate arrest and ban anticipatory bail.

Supreme Court

Justice Bhat said a court can quash the FIR if a prima facie case is not made out under the SC/ST Act and the liberal use of anticipatory bail will defeat the intention of Parliament.

The SC verdict came on a batch of PILs challenging the validity of the SC/ST Amendment Act of 2018, which was brought to nullify the effect of the court’s 2018 ruling, which had diluted the provisions of the stringent Act.
